Terms of Service

These Terms of Service govern your use of Crive, an online marketplace for buying and selling vehicles by auction.

1. Acceptance of terms

By creating an account, listing a vehicle, placing a bid, or otherwise using Crive (the "Platform"), you agree to be bound by these Terms of Service, our Privacy Policy, Cookie Policy and any policies referenced within them. If you do not agree, do not use the Platform.

2. Eligibility

You must be at least 18 years old and legally able to enter into binding contracts to use Crive. Sellers and dealers must additionally complete our verification process before publishing auctions.

3. Accounts

  • You are responsible for keeping your login credentials confidential.
  • You must provide accurate registration information and keep it up to date.
  • You may hold one personal account. Dealership accounts are separate entities.
  • We may suspend or terminate accounts that violate these Terms.

4. Role of Crive

Crive provides technology that connects buyers and sellers. We are not a party to the sale contract between users and do not take title to vehicles listed on the Platform. Contracts of sale are formed directly between the winning bidder and the seller.

5. Listings and bidding

Sellers must comply with the Seller Rules and Auction Rules. Buyers must comply with the Auction Rules and Community Guidelines. A confirmed winning bid at or above the reserve price is a binding commitment to purchase.

6. Fees and payments

Crive may charge listing, success or subscription fees, disclosed in your dashboard before you commit to the fee. Payments are processed via our payment partner. See our Refund Policy for cancellations and refunds.

7. Prohibited conduct

  • Listing stolen, encumbered or misrepresented vehicles.
  • Shill bidding, bid manipulation or coordinated bidding rings.
  • Circumventing Crive to complete transactions off-platform.
  • Harassment, hate speech, fraud or unlawful activity.

8. Disclaimers

The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Crive disclaims all warranties, express or implied, regarding vehicles listed by third parties.

9. Limitation of liability

To the fullest extent permitted by law, Crive's aggregate liability for any claim arising from your use of the Platform is limited to the fees you paid to Crive in the 12 months preceding the event giving rise to the claim.

10. Changes to the terms

We may update these Terms from time to time. Material changes will be notified via email or in-app notice at least 14 days before they take effect.

11. Governing law

These Terms are governed by the laws applicable to the jurisdiction in which Crive is established. Disputes will be resolved in the competent courts of that jurisdiction, subject to any mandatory consumer protections available to you.
